- Now that the New Year is behind us it's time to get down and

- serious - computer security is without doubt the issue of the

- day. Recent 'hacker' trials and the accompanying publicity

- are just the tip of the iceberg. New articles surface in the
-
- mainstream press each day about hackers and their outrageous
-
- ability to access computer systems, leaving major systems at
-
- risk, compromised by lax security.

- This is hardly a comforting thought. There are massive data
-
- stores maintained on the American public which can provide
-
- information on virtually any facet of your private life,
-
- ranging from what your paycheck was last week and how
-
- regularly (or irregularly) you pay your bills to the brand of
-
- cereal you've got in the kitchen cupboard, whether or not you
-
- send your shirts to the laundry, and if you do, whether or
-
- not you use starch!

- ELECTRONIC FRONTIERS AND THE EFF
-

- It's a new frontier. Quite literally. It's very different
-
- from anything else we've ever experienced, and light years
-
- ahead of the legislation we've enacted over decades to
-
- protect the rights granted to us under the Constitution and
-
- Bill of Rights. We're flying by the seat of our pants, and
-
- in this time of challenge and growth, we're flying blind much
-
- of the time.

- The Electronic Freedom Foundation is a non-profit
-
- organization established in 1990 to promote the public
-
- interest in the development of computer-based communication
-
- technology. The founders and directors of EFF include
-
- Mitchell Kapor and Steven Wozniak, two of our nation's
-
- leading experts in the area of computer technology. Mr.
-
- Kapor founded the Lotus Development Corporation and designed
-
- and developed the Lotus 1-2-3 spreadsheet software. Mr.
-
- Wozniak was one of the co-founders of Apple Computer, Inc.
-
- These individuals have comprehensive knowledge of the
-
- developing computer-based technologies and the promises and
-
- threats they present.

- The Foundation's goals, as set forth in its mission

- statement, are as follows:

- . To engage in and support educational activities which

- increase popular understanding of the opportunities and

- challenges posed by developments in computing and

- telecommunications.

- issues underlying free and open telecommunications, and

- which will ease the assimilation of these new technologies

- computer-based communication smedia. Support litigation in

- the public interest to preserve, protect and extend First

- Amendment rights within the realm of computing and

- telecommunications technology.

- . To encourage and support the development of new tools which

- will endow non-technical users with full and easy access to

- computer-based telecommunication.

- The EFF's commitment to its principles is reflected in a
-
- motion recently filed in a case currently being prosecuted
-
- against Len Rose, indicted with violations of the Computer
-
- Fraud and Abuse Act of 1986. This case, which is being
-
- watched nationwide, raises a constitutional question of first
-
- impression involving the CFAA that will have a profound
-
- impact on the development of computer-based communications
-
- technologies. For that reason, EFF has requested the court
-
- for leave to appear as "Amicus Curiae", or friend of the
-
- court, to provide insight and support for the defendant's
-
- motion to dismiss portions of his indictment as being
-
- unconstitutionally overbroad and vague, and as such, in
-
- violation of the First and Fifth Amendments.
